Oracle issues force majeure for New Mexico AI campus

Oracle has issued a force majeure notice for its 2.45-gigawatt Project Jupiter data center in New Mexico, allowing the company to delay payments if the site misses its 2028 launch target.

Oracle sent the notice to a unit of Blue Owl Capital, the developer behind the Project Jupiter campus in New Mexico. While Oracle does not intend to back out as the primary tenant of the Stargate initiative site, the legal move safeguards the tech giant by allowing it to defer payments if the facility fails to meet its scheduled 2028 operational deadline. Both Oracle and Blue Owl have downplayed the move, with Oracle stating that the project "remains on our planned schedule" and that it is dedicated to the state.

The campus is designed to support a massive 2.45 gigawatts of capacity, relying on gas-powered fuel cells supplied by Bloom Energy. However, the project has faced significant infrastructure bottlenecks. An Energy Transfer pipeline designed to supply gas to the site was delayed by nearly six months to February 1, 2027, following regulatory permit rejections that forced a route change in August. Additionally, New Mexico's environment department faces a November 23 deadline to rule on a pending air-quality permit for the fuel cell system.

Project Jupiter is a cornerstone of Stargate, a massive AI infrastructure partnership between Oracle, OpenAI, and SoftBank. For AI practitioners and developers, the friction surrounding this flagship site highlights the intensifying physical and political hurdles of scaling next-generation compute. As developers rush to build out massive capacity for resource-heavy models, local environmental opposition, regulatory scrutiny, and energy grid limitations are becoming the primary bottlenecks for AI deployment. Oracle has launched a public outreach campaign to ease local tensions, but the legal precaution shows that even the most high-profile AI infrastructure projects are vulnerable to real-world delays.
